Three Types of Criminal Offences
Under the Criminal Code of Canada, there are three categories of offences:
Summary offences – These are the least serious criminal offences. They must be charged within 12 months of the incident and are heard in the Ontario Court of Justice before a judge alone. The maximum penalty is 2 years less a day in jail, a $5,000 fine, or both.
Examples: trespassing at night
Indictable offences – These are the most serious offences and carry much heavier penalties, ranging from long prison terms to life sentences. There is no time limit to lay these charges.
Examples: murder.
Hybrid offences – These offences can be treated as either summary or indictable, depending on how serious the Crown believes the case is.
Examples: assault
